Crown makes new push to have NHLer’s text messages used as evidence at trial of ex-world junior hockey players

Cunningham is talking about the accuracy of Howden’s text message.

A reminder — this message involves Howden’s comments to Raddysh regarding the alleged slap of the complainant’s buttocks by one of the defendants, Dillon Dubé.

In one of the messages, Howden says: “Dude, I’m so happy I left when all the shit went down.”

“Man, when I was leaving, Duber [Dubé] was smacking this girl’s ass so hard. Like it looked like it hurt so bad,” Howden texted.

Cunningham said it’s reasonable to conclude Howden would not have said this unless that message is true and accurate because it reflects poorly on Dubé.

There would be no reason to fabricate or exaggerate to make things worse than they were as there was a Hockey Canada investigation going on, Cunningham said.

The words in the texts are “clear and unambiguous,” she said.
